DMCA Policy for Banana Bread Cake

"Banana Bread Cake" ("we", "us", or "our") respects the intellectual property rights of others. It is our policy to respond to any claim that Content posted on our service infringes on the copyright or other intellectual property rights (hereinafter "Infringement") of any person or entity.

The Digital Millennium Copyright Act of 1998 (DMCA) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. Filing a DMCA Notice

To file an effective DMCA notice, please provide our Copyright Agent with the following information:

  4. Your address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Filing a DMCA Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notification containing the following information to our Copyright Agent:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court in [Your Country/State/Region, e.g., the judicial district in which the address is located] and that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a valid counter-notification, we may reinstate the removed content in 10 to 14 business days or more, unless the copyright owner files an action seeking a court order against the content provider, member or user.
